Rules Adopted

T Board of Managers of the Riley Purgatory Bluff Creek Watershed District adopted rules on Wednesday, November 5, 2014.  The RPBCWD rules are effective January 1, 2015. The District engineer will review site and grading plans, designs, architectural drawings and other project-development materials submitted by or on behalf of a watershed property owner on or before February 1, 2015, and make a recommendation for disposition based on the extent to which the applicant progressed with development of designs and plans prior to the adoption of the District rules and the degree to which revision of the designs and plans to achieve strict compliance with all applicable District regulatory requirements will present practical difficulties – namely, unreasonable expense and delay – for the applicant or property owner. All permit applications filed after February 1, 2015, will be analyzed and decisions by the District to approve, approve with conditions or deny will be made in accordance with the District rules as adopted. 

 

A copy of the rules has been mailed to each of the cities within the Riley Purgatory Bluff Creek watershed, and each city has been notified that the Board of Managers has adopted the rules.  The RPBCWD rules were adopted and this notice is provided in accordance with Minnesota Statutes section 103D.341.

 

The rules implement the policies and goals articulated in the RPBCWD’s Water Management Plan as amended in December 2013.  The rules regulate floodplain management and surface drainage alterations, stormwater management, erosion and sediment control, waterbody crossings, wetland and creek buffers, shoreline and streambank improvements on public waters and all watercourses (creeks), sediment removal from public waters and appropriations of groundwater and public surface waters.  In addition, the rules provide procedures for the RPBCWD’s application-review process and implement permit fee and financial assurance requirements, pursuant to watershed district authority under Minnesota Statutes section 103D.345.
